Data from the device may be deemed discoverable by third parties and used in accident investigation and/or litigation. Allstate and/or the participant may be legally required to provide the data to others or their legal counsel, and you should not expect to retain data privacy or confidentiality. Unless you specifically make a request to us in writing, we will not use data obtained from the device to resolve any specific claim you or another operator of your vehicle may make with us.
This is interesting. I know for a fact that this device monitors speed. Theoretically, if one had an accident, the other party could subpoena the Drive Wise record and possibly determine the speed at which a Drive Wise participate was traveling. I'm not mush of a speed demon, but this gave me pause.
If I want my data used to resolve a claim, say to prove I was not speeding, I must make this request in writing as Allstate will not automatically access the data.
I've decided to go ahead with the experiment but may have to seriously reconsider the telematic device if it does not yield enough savings in premium.
